Hey! Don't stop reading this just because y o u don't live in California! You are about to be grabbed right where it hurts the most : in the pocketbook. Maybe you don't give a damn abou t what happens to the Califorhia motorcycle dirt, but you can bet that if Senators Cranston and Tunney pull this caper off in California, your state will b e soon follow . . And in the meantime, y o u , as a. taxpayer, will help pay for California's desert p ark. Yep! To the tune of $28,600,000. Now that I have your a tte n tio n , perhaps you would like to read essen tially what Senators Cranston and Tunney would use y our tax do llars for. As a suggestion , don 't read this on a full st omach I • • • • • • A BILL To establish the California Desert National Conservation Area, and for other purposes. Be it e n ac t ed b y the Senate and House of Representatives of the United Stat es of Am eri ca in Congress assembled, That (a) the Congress finds that- - (I) the California d esert co n t ain s historical , s ceni c , archeo logical, environm ental, biological , cu l tural , scien tific , and educational re sources that are unique and irreplaceable; - (2) man y . of these resources a re immediately threate ned, including certain rare and endangered species of wildlife, plants, and fishes that are unique to th e California desert, whose habitats are being altered or destroyed by m an 's growing influence in the desert ; (3) the desert environment is a total ecosystem that is extremely fragile, easily scarred, and slowly healed ; (4) the desert environment is seriously threatened by air pollution, indiscriminate off-road vehicle use, i mproper grazing, c areles s mining operations, unp lanned d evelopment and con str u c tio n , poor land use, and the pressu res of growing re cr eation al use: (5 ) th e interrelationship o f man and his des ert e n vi r o n me nt is p oorl y under sto ad ; (6) th e pro ximi ty of the lands of the California d esert to the rapidl y growin g p opul ati on c e n t e r s o f so u the rn California m ak es th e Ca lifo rn ia desert at o nc e a uniqu e recr e ation al a n d ed ucational re source an d a resource in · n eed o f special protections; (7 ) in ord er to st u dy th e interrelation ship of man an d hi s de sert environment an d to p reserve th e unique . and irreplaceable res ources o f th e California desert, man's ac tivities must be limited to those w hich do n ot disturb the natural setting, destroy the scenic b eauty, or upset th e fragile ecolog y of th e California desert; (8 ) in order to maintain environmental q uality and ec olo gic al diversity and to con tro l resource use , immediate st eps must b e t aken to deve lop a co m p reh en sive plan for the preservation of th e dese r t e n viro n me n t and for th e utilization of the desert's renewable resources wi thin a framework of management which relies on the principles of multiple use and the maintenance of environmental quality . (b) It is the purpose of this A ct to provide for th e immediate and future protection and administration of such public lands in th e California desert w ithin the fra mework of a program of multip le use and . th e mainten ance of environmental quality . the Ca lifornia Desert National Conservation Area. SEC . 5. (a) T he Se cretary shall be responsible for the preparation of a long -range pr ogram for the management , use, and protection of the con se rva tion area. (b) Such program shall include a plan, to b e co m p le ted and reported to Congress by June 3 D, 1979, for the future management, usc and protection of th e co n se rva tion area. (c) During the _period beginning on the date of enactment of this A ct, and ending at t he time of implementation of the long-ran ge plan the Se cretary shall execute an interim program to manage and protect the conservation area resources n ow in danger of destruction, to provide for the public use o f the area in an orderly and reasonable manner su ch. as through the developmen t of campgrounds and visitor cen ters, and to provide for a uniformed ranger protection and maintenan ce operation. (d) During the interim p eriod beginning on th e enactm ent of this A ct, and con tin uing after the final pro gram has be en co m p le ted , th e Se cr etary shall b e authorized t o co n trac t with State and local government units in d eveloping ad van c ed p r o gr a m s for law enfor c em en t. SEC . 6 . (a) The Se cr etary m ay acquire by purchase, exch ange , or otherwise, su ch lands or in terests therein as he deems ne cessary to provide access to the facilities of the co n se rva tion ar ea. (b) ( I ) Notwithstanding any o th er provision o f law, in exercising the ex change authority granted by subsection (a) of this sec tio n , the Secretary may ac cep t title t o any non-federal property or in terests th erein under his jurisdiction whic h he classifies as suitable for ex change o r other disposal. The valu es of the lan d s so ex changed shall be approximately equal, but if they are not ap p ro x im a tely equal the differen ce in value shall be equalized by th e - payrnen t of mone y to the grantor or the Secretary, as the case may be . SEC. 3 . (a) There is hereb y established the California Desert Advisory Commission . The Commission shall consist of a rep rese n ta tive from ea ch Federal agency h aving jurisdiction o r con tro l over lands within the Ca lifornia d esert, re p rese n ta tives of State and local go ve rn me n tal units (including law en fo rce me n t agencies ), repres en tatives of th e acade mic c o m m u n ity having exper t ise in this field , representatives of residents o f the California de sert ( i n c l u d in g Am eri c an Indians ) , enviro n m entalis ts , a n d representa tives of group s which make u se of th e California d esert an d its reso urces for p urposes . o f recreatio n, study, o r busin ess. SE C . 4. In orde r to ca r ry o u t th e purposes o f this A ct, th er e is es tablish ed SEC . 8 . The Secretary shall issue such regulations as he deems necessary to carry o u t the provisions of this A ct. Notice of proposed rule making shall be furnished to the President of the Senate and the Speaker of the House of Represen tatives an d published in th e Federal Register and in a t least one newspaper of general circulation to the a rea affe c ted by the proposed rule . The n otice shall in clude as a minimum : ( I) a st atement o f th e tim e , p la ce, and n ature o f public ru lemaking p ro ceedings; " (2 ) refer en ce t o the authority under which the rule is proposed ; (3) either the terms o r su bstance o f th e p rop os ed ru le or d es cription o f th e subj ects and issu es in vo lved in cluding in eit he r event the p roje ct ed impact o f th e p roposed ru le o n u ser s, p otential use rs, a n d the gene ral public ; and (4) the tim e , date , an d place o f public h earings to b e held. The no tice required by this secti on shall incl ude provision b y th e age ncy for anyone in te rest ed t o participate in the rulemaking, within not less than thirty da ys or more than n in e ty days thereafter, through submission of written data, views, or arguments with or without opportunity to p resent the same orally in any manner; and after cons idera tion of all relevant matter presented , the age n cy shall in corporate in an y ru les adopted a co n cis e general statemen t of their basis and purpose. Public h earings sh all be h eld on any proposed ru le that will have a significant impact on the ad mi nistration and u se of the conservation area. SEC. 10 There is authorized to be ap p ro p ria ted not to exc eed $ 2 8 ,6 0 0 ,0 0 0 fo rthe purposes of this Act, such .. am ount to remain available until expended. • • • Maybe you didn't see it in there, but if enacted this Law gives the Secr etary of the In te rior a uthority to close down the e n tire California Desert to any .off-road veh icle use. Further, this bill , if en ac te d, wi ll give the BLM th e full authorit y to b ecome gun-toting, enforcernen t officers . T he first time a BLM Ranger packs a gun . in t o the California Desert, it's going to be like "cow b oy s and injuns" allover again . We will b e th e "injuns." California off-readers will b'e writin g letters to their ele c ted representatives in Washington, D.C. on this issue but that won 't b e e n ou gh. Every State S enator and State Representative in our Nation's Capitol will have th e opportunity to vote on what happens to the California De sert. You can stop th is nonsense today by writing . a le t te r to your ele cted rep resentatives w hich states merely, "Vote NO on Senate Bill 63" . You must act now. Don 't wait for George to do it !
