S. all cu rre n tly en fo rce sim ila r rules fo r th eir national even ts, an d Youngblood ar gued that it w as im p erative th at the FIM give endorsem ent to th e in te rn ati o nal practices employed by its m ajor member nations. The new rule p assed the CTI nearly unanimously, w ith one nation abst ain in g. - Agreeing with the legislation , cn ehariman Helmut Boensch of Germany stated, "We must not wait for the environrnen tal protection agencie s of the various nations to issu e recommendations and regulations. We mu st move ahead and show ou r governments th at we are able to co n fro n t these problems ourselves. Oth erwise w e op en our sp ort t o cri t ici sm an d b ad publici ty. " In a d d it io n , th e T ech n ical Commission of the FIM has endo rsed American Motorcycle Association noise received t ec h n ica l assis tance from the m ag azin es' ed it o rs and , . m ore im portan tly, th e use of th e firm's attorney , William A. V erry , Mar ch 22 , 1972, in Fullert o n 's Munici pal Court, argued th at both law s ar e not only unenfo rceab le, but unconsti tu ti onal d ue to their offering no legal guidelines fo r enforceme n t other than "in th e office r 's judgment." J udge Verry , ' in findin g McCormick not gu ilty , agreed wi t h Fei nberg 's argume nt ab o ut th e co nstitu tio nality of the two statues. Upon ratification of th e tw o FIM Sp o rt Com mis sion measures, President Hendrik Bu rik of Holland suggested that a realistic approach to - the future of the mo t o rcy cle sport would d ictate th at th e CTI should begin considering similar silencing methods for speedway racing as well. McCormick was cited in the City o f Fullerton under two California vehicle cod e statutes: 24008 and 24008.5. The former forbids the operation of an unsa fe motor vehicle ; t h e latter makes th e alteration of a vehicle's center of gravity illegal. At the time cited, McCormick was riding a customized Harley-Davidson - a " chopper" which featured an ex t ended front end of his o wn manufacture.
