The first revelation of the noise rules' impact in Cycle News posed far more questions than it answered, so CN telephoned th e Oregon DEQ. office to attempt to clear up the uncertainties. Direct from the horse's mouth, so to speak The Department spokesman revealed th at the program had, in fact, been in effec t during 1975. The basic regulation prohibits the sale or offering for sale of any new motor vehicle which exceeds noise limits specified by the DEQ (Table A) . The department realized that adequate noise data was not available for 1975 motorcycles, but sent letters to all known motorcycle manufacturers requesting that the firms set up noise test programs in their own facilities and certify to the DEQ by mail those models in their product line which conform. Pressed further, he admitted th at , to the extent the sport is being fed by backyard racers, there will be some restriction, however, the DEQ does not view this as an insoluble problem. Most of the problems concern racing machinery, and the excep t ions proposed to handle racing machinery. The regulation states that "Racing vehicles will be exem p t ••• if it can be adequately demonstrated to the Department that these vehicles are used exclusively in sanctioned racing events." The controversy stems from the way this rule is to be in terp ret ed and put into practice. May a dealer displa y a race bike? The Department's position is no, if the , display can be termed an offer for sale. The DEQ is currently meeting with dealer and MIC representatives to try to agree on what kinds of display (if any) may be acceptable to all parties. How does this affect advertising? No Oregon dealer may advertise, in the local media or in an out-of-state publication (such as CN) the sale of a non-conforming (race) machine. This ruling does not cover media advertising that originates out-of-state. (Example, a race bike ad placed by the manufacturer in an out-of-state publication.) What criteria will be used t o judge if an applicant for exemption is a serious racer? The spokesman could not give specific criteria, and seemed surprised that CN had obtained a copy of the application form . The DEQ's position is that the intent of the rule is to prevent to court, and then it would be for the court to decide. How did DEQ Director Loren Kramer come to characterize motorcycles as " the number one noise problem in Oregon ?" This came as the result of surveys taken at a series of public meetings held throughout the state to gain citizen input on noise emission problems. Apparently the tabulated citizen complaints against motorcycle noise' surpassed all others. The DEQ has not attempted to calculate aggregate sound pressure levels in a manner sim ilar to the federal EPA (in which the sound level of a given source is multiplied by the number of such sources in use to obtain a statistical estimate of the extent of the noise problem) . Motorcyclists "weren't excluded" from the public noise control meetings , but neither did the DEQ attempt to get in touch with motorcycle groups specifically on the subject.
