Hughes Tops Adelanto WORCS {tf/ \ ;' A a t i- IA tu \', an rt-'a Land Wars: An OHV YictorylAn OHV Lawsuit The San Bernardino County (California) Board oI Supervisors unanimously passed an OHV ordinance on April I I that is fair to both off-roaders in the county and residents who have valid complaints, accordinS to the Off- Road Eusiness Association (ORBA). But the Riverside County (C-alifornia) situation that didn't turn out as well, has resulted in a law- suit being filed atainst the county of Riverside alleging that the county's recently adopted noise and OHV ordinances violate state law. Early on in the San Bernardino process David Hubbard. an attorne/ for EcoLotic, suttested the formation of a group of stake- holders comprised of environmentalists, OHV organizations and communily groups from around the county. The goal of this group was !o find a compromise on this sometimes very contentious issue and then 8o before lhe supervisors, united in their sup- port for lhe agreement reached. After two very long meetings, the stakeholders agreed on the language used in this ordinance. The compromise includes no property- line setbacks, no maximum number of motorcycles per acre, no restrictive-riding period, and no permit process for the person wanting to ride on their own property and not use that property a5 a statint area. A per- mit is only required if rhe propercT owner plans on stagint more than l0 off-highway vehicles on a property. h does include a process by which residents can seek ludicial relief from nuisance and harassment. The ordinance inalLrdes a noise element requinnE off-highway vehicles ridden on private prop- erry to measure 96 decibels at the (exhaust) pipe, lhe same standard required on California public lands. Orher counties have not taken into consideration the needs of all members of cheir constiruency, San Bernardino County wanted to address rhose concerns and followed throu8h with an ordinance that is fair and reasonable to all citizens." The lawsuit aSajnst Riverside County, meanwhile, has been filed by Ecologrc Partners, lnc., the Off-Road Business Association (ORBA), the San Diego Off-Road Coalition (SDORC), the california off-Road Vehicle Association (CORVA), AMA District 37 (Al'1A D37), and the American Sand Association (ASA) The lawsuit filed in Riverside Count), Superior court alleSes the noise and OHV ordinances violate various stare regulations on four separate issues. The noise ordinance is inconsistent with the county's general plan, which is a violarion of state planning and zon- rnt laws. according !o ORBA, and rhe section of rhe OHV ordinance that requires riders to carry wrifien permission when on private properq/ is in direct conllict with California State Penal Code 8602.2. The OHV ordi- nance also fails to include a "grandfather" clause to protect the vested rithts of landowners who have used OHVS on therr propenies for many years. Finally, ORBA says the county's environmental review of the two ordinances were wholly inadequate as they have failed to account for the many impacts expected once OHV use on private land becomes subjected to lhe severe restric- tions imposed by these ordinances. "we tried to have lhe deficiencies in this ordinance corrected prior to its approval, the supervisors chose to ignore our comments and this lawsuit is our only recourse," Hubbard said. T \ < \ 'l \ Team Suzuki OII-Road's Ryan Hughes returned to his winning ways at $e fifth round of the Rocky Mountain World Ofl-Road Championrhip Series in Adelanto, Califomia, April 16. After winning the first two rounds, then finishing third and second at the nex tvvo, respectively, Hughes found his way back to the top step of the podium with a win at RaceTown 395. Riding an RM- 2450, Hughes took the checkered llag ahead of lYontclair Yamaha,/Zip-Ty Racing's Bobby Garrison and Kawasaki Team Green's Ricky Dietrich who joined Hughes on the podium. Defending WORCS Champion Nathan Woods finished founh on his Team Green Kawasaki KX450E while Montclair Yamahy'Zip-Ty Racing's Ty Davis rounded out the top five. Finiihing sixth was previous-round winner Mike Kiedrowski, Hughes' teammate, and seventh place went to lGwasaki's Lance smail, Mike Corder (KTH), Matt Karlsen (Kaw) and Russ Pearson (Yam) tllled out the top l0 overall.
