Helmet Law: Generally speaking, if the vehicle is larger than 50cc or generates more than 2 hp and is capable of exceeding 30 mph, then: Operators under 21 years of age must be helmeted and wear protective eyewear; operators 21 or older are not required to wear a helmet but must wear protective eyewear; and passengers are bound by the same helmet requirements but need not wear eyeglasses no matter the age.- Also, persons choosing to ride helmetless must have an insurance policy providing at least $10,000 in meclical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle. Noise Ordinance: Recently, the Daytona Beach City Commission passed a noise orclinance, and, contrary to what you may have heard, the sky is not falling, and everyone who heads to the community will not be cited. The new law was designed to address the concerns pf local residents and visitors as it relates to excessive noise and intrusion into neighborhoods during bike events. The objective of the orclinance is not to affect our law-abiding visitors to our community, but to target those very few whose actions make it disruptive for other visitors as well. Generally speaking, referring to the recently adopted noise ordinance of the city, 42216: "No person occupying any public right-of-way in the city (sitting on a motorcycle on Main Street) shall operate any noise·creating device (motorcycle) for the purpose of draWing attention to the source of the noise (oohs and aahs from the crowd)" A specific description of this activity is included in the ordinance: "rapid throttle advance (revving) of an Internal·combustlon engine resulting in increased noise from the engine." This is also known as throttle-jockeying. Be assured that the Daytona Beach Area will continue to welcome their bike·event visitors with open arms and are grateful that the riders choose to come to their area.
