As we left the courtroom, I witnessed something that I had never before seen in Federal or State Court; the court's clerk approached us, extended his hand to each of the four bra ve men , and said, " Gen tlemen , I applaud your courage." Let each of us who cares about o ur sport - our passion - join in that applause. Maybe the resulting thunder will be loud enough to rise above the di n of misinformation and hysteria spewed by dishonest publ ic servants and cowards o utside and in side the OHV community and will sound bells of freedo m and reason for the m ultiple use of o ur public lands. Unfortunately, for technical legal reasons, none of these and other shocking behind the scenes revelations co u ld be submitted for the j u ry's consideration. The jury was simply ch a rged with the narrow task of d etermining whether any of the defendants knowingly entered a closed area. , At tria l, BLM ranger Sasseville (second i n command to P ro bert ) testified tha t he deliberately m isinformed the public regarding which BLM map should be used to avoid temporarily closed areas: P ro bert testified that the special closure map provided by the BLM was almost impossible to comprehe nd. The jury learned th at Sasseville viciously at tacked defenda nt Lowell Webb, knocking him off h is motor cycle while travelling at betw een 20 to 30 miles-per- hour. The BLM ra nger had actually laid in wai t beh ind bu shes and the pi llars of a freeway underpass to ensnare the unsuspecting Mr. Webb as he exited the tunnel. Sasseville was characterized as a " savage" and "beast" by severa l members of the jury who acquitted Mr . Webb of any wrongdoing. In . the end, Messrs. Sieman , Van Dyke, M artin and Holmes were found to have kn owingl y entered the closed area: a simple trespass. The BLM then showed its tru e colors by replacing their trial cou nsel with a sentenc ing "e xpert " wh o argued for a manda tory term of six month s imprisonment for Mr. Siernan, $1000 fine each (do wn from $100,000 fin e origi na lly soug ht), and probation for all. Ama zingly, the BLM argued tha t Mr. Sieman's role as a publisher and protestor demonstrat ed criminal intent ak in to th at of an organized crime conspi rator and was a proper bas is for in creasing hi s punishment.
