T he O regonian repo rt ed tha t th e Oregon Court of Appeals last week upheld a $5.7 million damages award against Honda becau se of a 1985 accident in wh ich an AT V driver was serious ly injured. T he award included $5 milli on in pu n itive da mages and $735,000 in compensa tory damages. Honda argued that the award of punitive dam ag es was unco nstitution all y excessive, bu t the court said that co ns ti tu tio na l p rov isions o n excessive punishments don 't app ly to civil lawsuits between pr ivate parti es. H ey, dude, it' s almost Commotion By The Ocean IV tim el The Racing Enterprises Motocross-prom oted MX will take place at southern California's Carlsbad Raceway, August 17-18, on a tr a ck that seven -ti me Na tional Champion Rick Johnson helped to design. In addition to the Pro class race that will be open to all sizes of bik es, a 125cc Pro class race has been added for this year 's edition of the annual event. Round 10of th e World Champi onship 250cc MX Series has been canceled. The event was scheduled to tak e pl ace July 21 in Venezuela. It is still un clear Rainey- errs, Schwantz wins Dutch GP eam Lucky Strike Suzu ki 's Kevin Schwanu capitalized on a mi stake by Marlboro Yamah a Rob erts ' Wayne Rainey to win the 500cc Dutch GP in Assen, H oll and, on June 29. With the race stopped on the fifth lap due to rain and scorin g reverted back to th e th ird lap, Rainey (who was fifth when the race was stopped) had to beat Schwantz (third at the red flag ) by almost half a second on aggregate time . Ra in ey led the entire second part of th e race, bu t ran off the race track in the final chicane, allo wing Schwan tz to slip past for the victory. On aggrega te tim e, Schwanu beat Rainey by 1.090 seconds. T hird pl ace went to Rothmans Honda' s Wayne Gardner wi th Cagiva's Eddie Lawson and L ucky Stri ke Suzuki 's Didier de Radigues rounding ou t the top five finishers. The championshi p lead er goi ng into the Dutch round, Michael Doohan, crashed late in the race. Marl boro Yama ha 's John Kocinski fini shed sixt h wi th fellow Califo rnian Doug Cha ndler 11 tho Rai ney leads the championship over Doohan, 148-143, wi th Schwantz third on 123 points . With the lowest two scores sub tracted, Doo ha n leads Rainey, 128126, wi th Schwantz still third at 114.' The 250cc Grand Prix was won by Italian Pier-Francesco Ch ili on the factory Ap ri lia. Ch ili topped Rothman s Ho nda 's Luca Cadalora and Sharp-Sampso n Honda's Wilco -Zeelenberg. Cadalora leads Helmut Bradl (fourth in Holland) in the champ ionship , 158-141. German Ral f Waldmann rode his Honda to victory in the 125cc GP over World Champion Loris Capirossi's sim ila r RS125; Alessandro Gramign i finished third on an Apri lia . The Sidecar G P was won by Egbert Streuer and passenger Peter Brown, who rep laced Ameri can Peter Essaff, Streuer/ Brown top ped Rolf Biland and Kurt Waltisperg to take the win . The Guedel brothers were thi rd. T whether or not two other I25cc -MX G Ps, the July 14 Gua temalan GP and the July 21 Brazilian GP , will tak e pl ace. After th e South American MX federat ion reached a last-minut e agreement with the riders and teams a t the June 23 British GP to save th e GP s, the Dut ch airline that is providing transp ortat ion .gave a July J deadline for all the documents necessary to ship the team s' equipment from H olland. T he Irish GP took place two days before the deadline, and many team s were expected to mi ss the deadline due to th e tim e inv olved in transporting th e eq u i p me n t from Ir eland to Holl and. 'Motocrosser Jero my Buehl , th e runn er -up in the 125cc Eastern Regional Supercross Series, underwent knee surgery on June 27. Buehl injured the knee while practicing earlier in the season and is recuperating at his home in London , Ohio. Texan Doug Polen and fellow Ducati rider Stephane Merten s of Belgium took turns nipping each other at the finish line in the two-leg Austrian round of the World Championship Superbike Road Race Series at the Osterreichring, June 30. Mertens won . the opening leg by .178 seconds over Polen, who then edged Mertens by .218 seconds in the second leg. Defending' World Champion Raymond Roch e (Duc) fini shed a close third in both legs an d Rob P h illis (K aw) finished fou rth both times out, like Roche in co ntac t with th e leaders. Mertens mo ved by Phillis into second in th e point standings, but trails Polen by 33 points, 137-104. Phillis is third with 95. T eam Marlboro Roberts Yamaha 's J ohn Kocinski is scheduled to appear in Monterey (California) Municipal Court on July 12 at 8:15 a.m. in a cri minal case stemm ing from his arrest by Monterey County Sheriffs for reckless driving, fleeing an officer, and resis ting a public officer after the April 21 U.S. Gra nd Prix at Laguna Seca Intern at ional Raceway. Kocinski was originally schedu led to appear on May 13bu t was given a cont inua nce to May 30. A second con tinua nce was given on tha t date, and Kocinski will appear on July 12. LITTLE KNOWN FACT: Dutchman Ra cin g team m anager Dave Schlosser is the eq ui pment man ager for the Stan ley Cu p Champ ion Pittsburgh Penguins . Expect to see more invo lvemen t from ' Marlboro in the WERA Pro Se r ies. Inside sources say that the tobacco giant will likely becom e more active in pre-race publicity and also selected event sponsorship in 1992. There is also the po ssibility that Marlboro will attempt to persuade a few of the Grand Prix road racing stars to participate in selected F-USA rounds in 1992. Marlboro currently sponsors the Kenny Rob erts-owned team of Rich O liver and Robbie Petersen in the WERA Pro Series. Former AMA Grand National Champion Bubba Shobert was married to his longtime girlfriend Tara Sumners on June 22 in Carmel Valley, California. Shobert's best man in the wedding was 500cc World Champion Wayne Rainey, who returned to California from Europe for the ceremony. Shobert was working for Honda at Road America on June 29-30, signing autographs in their display tent as well as visiting local dealers . Another spectator at the J une 30 AMA Road Race National at Road America was Randy Renfrow. The Virginian is still recovering from the preseason crash at Will ow Springs that required the amputation of the thumb on his right hand. Renfrow has undergone several operations, including one that saw the thumb surgically replaced. "Getting back on one of these race bikes is a reallongshot at this point," Renfrow said . " Bu t I'm working out and we'll just have to wait and see: ' -Commonwealth Honda's appeal hearinl$ regarding_ the disqualification of Miguel D u H amel from the 600cc Supersport race at Brainerd International Raceway on June 9 will be held on Wedne sday, July 3, in Charlotte, North Carolina. Muzzy Kawasaki 's Rob Muzzy didn't make the trip to Road America for the June 30 AMA Superbike National due to health problems. The wellrenowned tuner is suffering from a heart condition that kept him away from th e National as doctors prescr ibe d rest for the 48-year-old Californian. The Texas World Speedway round of th e AMA Nati onal Road Race Ch ampionship originally scheduled for August 11 has been moved to October 4-6. CORRECTION: Kevin Ben n ett p iloted a Honda XR 250, n o t a n XR 600, to h is th ird place finis h in the Ju ne 9 Rh ode Islan d ro und of the AMA Nationa l Championshi p Hare Scram bles Series.
