California 'm clistswin legal otorcy battle over insurance I n what represents a major triumph for motorcyclists in California, the state Superior Court has terminated a lawsuit filed by the Universal Underwriters Insurance Company to deny riders the consumer protection benefits of Proposition 103, an insurance reform and rate reduction measure approved by voters in 1988. ' The victory is the result of the efforts of the American Motorcyclist Association and attorney Jonathan Home, an AMA member from Santa Monica, California, who filed 'an " amicus brief" in response to Universal's attempt to discriminate against California motorcyclists. ' , In the legal brief, the AMA challenged the insurance company's suit which charged that the mandatory rating criteria of Proposition 103 was never intended to app ly to motorcyclists. " T he language in the reform measure explicitly includes motor cycles within the definition of automobile insurance policies, and riders are enti tled to the same redu ction in rates as other vehicle owners, " wrote Horne in the brief. In addition, the AMA's brief noted that it was equally inappropriate for Universal to con tend that th e typi cal voter did not consider whether Proposition 103 would apply to motorcycle insurance. Horne argued that it was irrelevant to debate the intentions of voters; but what was important is that the reform package was approved by a majorit y of voters and clearly applies to motorcycle insurance. H orne also refuted Un iversal' s contention that it wo uld be too difficult to allow mo torcycl ists the required insurance dis counts because of Poor record keeping o n the pa rt of th e sta te's Department of Motor Vehicles. " The AMA supports an equitable system of insurance rate factoring wh ich is based o n infor ma tion regarding a motorcyclist's riding history," wrote Horne, " and mo torcycle riders sho uld not be denied the benefits of Proposition 103 sim p ly because of poor data recovery practices of the DMV. " As aresu lt of the swift action of the AMA and Home, Superior Court Judge Dzintra janavs ruled in favor of motorcyclists and the case was dropped on December 20. " T h e de ci sion represents 'a tremendous win for safe and responsible motor cyclists," said Home. "It 'finally gives California riders the assurance that insurance rates will be based on their safety records and riding patterns and not o n pre-disposed biases of the insurance industry." At the presentation of the Rothmans H onda .GP roa d race team at Doning-: 'ton Park. in England last weeken d, form er Wo rld ,' Cha m pi on Wayne Gardner said that if he gets hurt again he will probabl y quit racing. " I have been ridin g in pain for so lon g tha t it's sto pped being fun .
