A federal district judge has temporarily barred sales of the Nolan N42 helmet bearing the Snell certification seal in the U.S. beeause Nolan falsely claimed in an ad in the April 1989 issue of Motorcycle Industry magagzine that it meets Snell Memorial Foundation standards. after the helmetfailed Snell's tests and was decertified last December. The order also prevents Nolan from claiming through advertisements or other means that Snell certifies or approves the N42. or any of Nolan's helmets. Snell's attorney in the case. Paul H.-Appel of Lowy 8a Chernis P.S. in New York. said. "We will take every step available under the law to protect Snell's reputation for maintaining the highest safety standards for recreational helmets and will ask the Court for a recall of all Nolan helmets on the market bearing the Snell seal."
