T he deadline for the filing of fin al consent decrees bet ween AT V man ufacturers and th e U.S. Consu mer Product Safety Commission (C PSC) was ex tended today fro m March 7 to March 14 foll owing an open di scu ssion in U.S. District Co urt for th e District of Co lumbia. Federal Judge Gerha rd A. Gesell granted th e extension to give th e C PSC a nd ATV ma nu fac turers a nother week to complete nego tia- tio ns before su bmi tti ng proposed fi na l co nse n t decrees. It was th e seco nd deadline ex tensio n gra nted by Gesell since preliminary decrees were signed December 30. The judge a lso ru led th at no further extensions will be granted. In prelim ina ry decrees (co urtap proved n eg otia ted settlements ) betw een the CPSC and ATV ma kers , ma n ufacturers agreed to no lo nger market th ree-wheeled ATVs in th e United States and to buy ba ck all never -before-sold th ree-wh eele rs in dea ler in ventories. When th e preli- ' minar y decrees were signed , th e co u rt set a 45-day deadline for th e filing of fina l decrees. Co ngressiona l cr itics blasted the pre limi na ry decrees as "woefu lly deficie nt " even before they we re signed, cha rg ing that th ree-w hee led ATVs shou ld be bann ed o utright a nd demanding tha t ma nufacturers be fo rced to offer refunds to owners of thr ee-wh eel ers wh o voluntaril y return the m to dealers. Two bills that would mandate the ban a nd voluntary reca ll of a ll threewhee led ATVs, in cluding provisions wh ich would esta blish refunds for co ns u me rs' who voluntaril y return the ir vehicles, recentl y were introd uced in both houses of th e U.S. Co ngress. S20 16, a bi ll introduced J anuary 28 b y U. S. Senator Alfon se M, D'Arn at o (R-New York ), would ban a ll three-whee led ATVs and a ll ch ild-s ized ATVs. D' Amato 's "Em erge n cy A llT errain Vehicle Safety Act " a lso wou ld force th e C PSC to develo p a rule for pro viding to co ns u mers, "reasonab le ref u nds of th e purchase price for th ree-whee led ATVs, (an y) ad u lt-sized ATV p u rch ased for use by ch ildren u nder 16, a nd ATVs speci fica ll y designed fo r ch ildren u nder 16." U nder th e measu re, a ny vehicle retu rned to a man ufacturer or distrib ut or wo u ld be co ns ide red ba n ned a nd co u ld not be reso ld. D'Arnat o 's p roposal also wo u ld requ ire: • Free hands-on tra in in g in th e operation of ATVs to a ll vehicle owne rs, co u p led with adeq uate cash o r merch a ndise cred it incentives to enco u rage owners 10 take th e tra in ing cou rses; • An extensive pu blic no tice campaign to wa rn existing and prospective ATV ow ners of the hazards, especia ll y to ch ildren, presented by ATVs. T he wides p rea d mu ltimedia campaign wo u ld incl ude broadcast warnings on prime time television and radio, and p rinted warni ngs in newspapers an d magazines. Capitol hill sources sa id the two n e w meas ures we re int ro du ced because CPSC rea u thorization bi lls in both houses o f Congr ess - bi lls which a lso incl ude pro visions to ban three-wheel ATVs a nd to esta blis h a refund progr am - are stuc k in co m m ittee. Those m ea sures were introd uce d by two long-time ATV cri tics , Congressm an J am es J. Florio (D-New J er sey) an d U.S. Senator Albert Gore (D-Tennessee); Gore is o ne o f the front runners in th e bid fo r the Dem o cra tic P a ry ' s 1988 preside ntia l nomination. Barton 's bi ll is sched u led to be h ea rd March 16 b ef o re Florio's co ngressio na l su bco m m ittee (the co nsumer su bco m m i tt ee o f th e . Ho use Energy a nd Co mmerce Committee). The hearings wi ll be held on ly two da ys a fter th e fin al co nsen t decrees are to be filed with th e cou rt on March 14. In today's wr itten decision, Judge Gesell ruled th at persons not a party 10 the lit igation bu t who have been permi tted by the co u rt to adv ise it in some matter o f law that directly a ffects th e case (co m m on ly referred - 10 as " friends o f the co urt") must file a ll objections to the proposed fina l consent decrees by March 28. Ges ell a lso ru led that the CPS C and ATV m anufacturers will have until Ap ril 8 to file replies to the objections. Oral arguments o n the proposed fin al co nsen t decrees wi ll tak e place in U.S. District Court, District o f Columbia , between 9:30 a.m. an d 4:00 p.m. on Apri l 18. Gessel tod a y denied a motion by five public interest groups, and an in d ivid ua l, who as ked for th e lega l right to interven e in th e ca se. Washingt on so urces ca lled th e ruling a legal vi ctory for th e gov ernment. In ' a written co urt memora nd um , Gessel denied a motion for interve n tion from : th e Am erican Academy o f Ped iat rics, T he P ubl ic Health Association, Pub lic Citizen (a group associated with Ralph Nader), the Consum er Federation o f America, United S ta tes Public I n teres t (a seco nd gro u p associated with Nader) and Frederic H .K. Booth, th e ow ner of a 1985 Honda three-wheeler. In h is decision, Gessell said, "T o grant intervention would complicat e th e litiga tio n , promote delay a nd open th e prospect o f u ncertai nty. · T housands of individuals own ATVs and, arguab ly, u nder (th e lega l) co ncept of intervention an y or all of them might be entit led to intervene. as well as any health professiona ls treating or responsib le for these ATV us ers ." H ad interven tio n bee n gran ted , th e groups a nd Booth wo ul d have won th e righ t to a p pea l th e co urt's decisions in th e case a nd a lso would have acquired th e right to seek a stay of executio n for th e co nse nt decrees. T he Judge did issu e a n o rde r allowin g th e gro ups a nd Booth to become "friends o f th e court." That sta tus will a llow the m to file written co m me nts a nd to participat e in ora l argu m ents, G essel 's deci sio n will giv e th e gro u ps , a nd Booth, th eir day in co u rt wi tho u t a ffo rd ing th em legal ri ghts in th e case. In hi s decision, Gessel o u tlined hi s reasons for gran ting th e intervent ion appl ica nts "friends of the co urt" stat us . Gessel said the th ree p u blic in terest groups a re devoted 10 public hea lth a nd co nsumer safety, a nd " ha ve a n int erest in ensuring th at their members a nd o thers w hose in te res ts they rep resen t a re n o t injured b y the a lleged ly u n safe ATVs." T he judge added th at th e two me d ica l grou ps wh ich a ppl ied for i nterve nt io n a re , " p u b lic h ealth professio na ls respons ib le for p rotect ing th e health o f in d ividua ls livin g in the i r res pective co m m u n ities: They are justifiably co nce rned abo ut the injuries ca used by th e allegedly unsafe ATVs." .In Booth 's case, Gesell wrote, " H is int er est i s primari ly eco n o m ic. Unl ess th e fin al co nsent decrees require th a t the defendants bu y ba ck th e al legedly haz ardous vehicles, he fears that h e will be u nable to reco u p th e purchase va lue o f th e veh icle." " Friends o f th e co urt" a lso include Sen at or D'Amato , wh o filed a lega l brief critica l of th e co nse nt decrees on Mar ch 2. a nd a tto rneys ge nera l from severa l sta tes; th e National Asso ciati on o f Attorneys G en eral recently declared that ATVs a re a n im m in en t hazard. •
