O n September 6th, I sent a letter to Commissioner Sta tl er e x p res si n g these very views. I also informed h im that his unprofessional and antagon istic behavior during the Concord hearing was not o nly unbecomi ng of a U .S. Government official, but also clearly dem onst ra ted his inability to listen dispassionately to ev idence. His past, present, and any fu ture action on ATVs could seriously jeopa rd ize the ability of the CPSC to p ropose any sol utions to the ATV co ntroversy. I, therefore, requested Commissioner Statler to withdraw from any further consideration of the ATV investigation by the CPSc. So far, I have not heard back from Mr. Statler. If he declines to recuse h imself I will have no alternative but to ask the U .S. Dep a rt m en t of Justice to investigate the CPSC in general and Mr. S tatler in particular for possible violations of fed eral law. I am fully prepared to pursue all avenues to make sure both the sp ir it and letter o f the statutory mandate required of public officials are mel. ke Sat.
