Against AMA /BLM cooperation In a letter dated J u n e 6 R ick H ammel , AMA District 37' s BLM Coordinator a nd Legi slative Offi cer submitted a " Re port of th e Legal Defens e T ask Force" to th e District. In his report, H ammel revi ews current BLM regu lations which include cu rren t Green Sticki es a n d fun ctionin g spa rk arrestors (even a t desert races). It seems th at th e BLM is broke a nd ne eds m ore o f o ur tax dolla rs from th e sa le o f G reen Stic kies " to do m any o f th e funct ions th at pertai n to OR V ac tiv ity." Hammel recommends th at we show o ur ap p roval of a proposed new regulation requiring a sta tement on all entry form s that entra nts have current Green Stickies a nd a sp ark arresto r . . . a nd th at th e sponsor ing club check all finish ers for compliance a n d di squali fy violators a nd / o r ca use th em to be ci ted. In other words, th e BLM ha s issued so many regu lations that th ey can't en fo rce th em a ll. They want yo u and I to be th eir en forcers. And R ick Hammel is enco u raging us to obedi ent ly coope ra te! It is my opinion that Mr. H ammel has lost touch with the 'co m m on folk ' an d is eagerly embracing Big Bro th er 's directives in order to avoid controversy. This is NOT the a ttitude District 37 needs in their BL M Coordi nator , for it will inevitably lead to tota l govern ment co ntrol over the enjoyment of our own public lands. If government regulations seem unreasonable and im proper, th e solution is not to run out looking for fellow citizens in violation I We should work to cha n ge the regu la tion. CA For AMA/BLM Cooperation I receiv ed a copy of a letter written by Mr. Steve Hollis ter this aft ernoon regarding District 37' s interface with th e BLM 's Sla te la w compliance policy. I hope that th is reach es you in time to print co nc u rrent ly with Mr. Hollister's. Let me make th e readers awa re o f th e facts as th ey ac tua lly are. T he BLM receives funds for O RV ' projects from th e California Stat e orr H ighway Veh icle Fund. These funds a re in excess o f 2 mill ion per yea r. The OHV Commission has to ld th e Federa l agenc ies th at th ey will en force a ll sta te law s pertaining to OHVs or lo se th eir gra nts . The Vehicle Code clearly sta tes that OHV regi stration a n d silence rs must be o n a ll OHVs. The max imum so u nd level is 86dbA a t 50 feet o r 10IdbA a t 20 inches (+/3dbA). The spa rk arres tor regula tion is in the Ca li forn ia Resources Code. It sta tes that a spark arrestor must be in work in g orde r o n "any forestcovered land . brush -covered land, or grass-covered lan d ." T hese a re th e laws. T hey have been in p lace for ma ny years. The sta te is now requiring they be enforced. T he BLM ca rne to D-37's Legal Defen se Co m mi ttee in Ma y and told u s that th e laws a re go ing to be en force d . T hey sta ted tha t we co u ld do th is vo lu ntarily or th ey would have to u se th e law en fo rce me nt rangers to ensure co m p lia nce. We, as a co m m ittee. ch ose to comply. Our Board of Directors co nc u rr ed. The reasons for our ch o ice a re as follows: I. H th e rangers cite, th ey w ill cite for a ll violations. Fai lure to have green sti cki e, silencer under 105dbA , and no spark arrestor co u ld cost as high a s $300 . We did not wish to put our riders under tha t kind of jeopardy. We feel tha t the $90 for a si lencer spark arrestor plus the $15 for registration is m ore th an we shou ld ha ve to spe nd. 2. If we do not comply th e BLM has th e o p tio n of sto p p in g an event. They ca n ca ncel permits. They ca n mak e life pure hell for us . We discussed co u rt action . We conferred with our law firm and the answer was to co m p ly. R id ers lik e Mr. Hollister must rea lize th at we no longer ca n do as we w ish in th e desert or th e forest. Mr . H ollister suggests th at th e regulations be chan ged. That would take litera ll y an act of the Legislature or Congress. The chances for this are less th an n one. What legislator a re yo u go in g to convince to repea l laws on registration. excessive noise protection or fire protection? H you find one. we have so me wi lderness issues we wou ld like to discuss.
