'III'~"" ......... aoas I. .umL\ Yamaha's letter briefly mentions its "solving" of a patent problem with OMC in selling its outboard motors in the U.S. But the "problem" was in fact, a lawsuit filed by OMC - Outboard Marine Corporation of Waukegan, Illinois - against Yamaha, which presented an apparently substantial obstacle in Yamaha's overall financial recovery. The OMC suit demanded that Yamaha cease the import and sale of certain outboard motors, models which used design features that infringed upon patents held by OMC. According to Charles Plueddeman of OMC's public relations department, complaints were filed last Novemberagainst Yamaha Motor Company of Japan and its American subsidiary, Yamaha Motor Corporation, U.S.A., in both Federal District Court in Milwaukee and with the International Trade Commission in Washington D.C. OMC's actions claimed that the design and construction of the electrical systems in Yamaha's 9O-bhp three-cylinder outboard motor and their 1984-model V-four and V-six outboard motors were identical to systems of OMC's own design. Outboard Marine Corporation manufacturers and sells Evinrude and Johnson outboard motors and other marine-oriented products under those names. The alleged patent infringements by Yamaha, and the subsequent import and sale of motors with those infringing designs, represented potential and actual harm to OMC's own design efforts and market share of the outboard motor business, according to OMC. Plueddeman stated that Yamaha reached a settlement with OMC on March 26 and agreed to make certain changes on its motors as wei) as financial compensation.
