Legislative hearings on Desert 'Plan - this time BLM gets investigated The Legislature's newly created Subcommittee on Public Lands held a day-long hearing in Los Angeles on October 17 [0 hear ~ the public's complaints with the Desert Plan and the BLM. Our own "Assemblyman Bob Hayes is the 'chairman of this· subcommittee. and the BLM knew that they were going to have a hard time giving him the 'same snow job they usually present to Congressional committees. Assemblyman Hayes. Assemblyman Don Rogers (Bakersfield). Assemblyman Phil Wyman (Lancaster). and Assemblyman Bill Leonard (RedLlnds) showed up to question the BLM on their motives in perpetrating such a restrictive plan. Witness after witness testified that the BLM did not listen to the public and many offered evidence to substantiate their claim. Government agencies such as the Metropolitan Water District and San Bernardino County spoke against the plan. Witnesses from the mineral. energy and recreation fields complained about the BLM's tactics. Rick Gochnaur from CORVA presented some very well-researched testimony which suggests that the BLM is guilty of destroying public records. In what reminded most of those present of the Nixon era. CORVA explained a sequence of events which ended with the BLM claiming to have accidently erased some 20 hours of important tape recorded meetings on the plan. MteT the CORVA spokesman finished describing his astounding tale. Hayes instructed the court reporter to deliver a copy of the transcript immediately to the Attorney General for possible criminal charges against the BLM officials involved. if the CORVA 'charges against BLM prove to be correct. Without exception. everyone who spoke at the hearing complained about the total inadequacy of the time period which the BLM has provided the public to respond to the plan. Many speakers expressed tile opinion that the BLM obviously has no inten- tion of doing anything with the public's comments. The short period of time from the official close of public input (November 21) leaves no time to change the plan prior to submitting it to the Secretary of the Interior by DecemberS. The entire timetable is based upon the political reality that Carter may not be re-elected. and Reagan will not approve of the present BLM plan. The environmentalists want to score as many points as they can before they get tossed out of the game. It is too bad that they might get away with stealing the desert before they get tossed out. There is still hope. Assemblyman Hayes turned the entire hearing transcript over to the Attorney General to determine if there might be some legal steps which might be taken to protect the State's interests from being damagefi by the proposed BLM plan. Who knows. the Attorney General might be able to obta.in an injunction or other legal delay which would give everyone an adequate opportunity ttl work out a workable. fair Desert Plan. C. N.
