Several aftermarket manufacturers have the sophisticated equipment and muffler know-how to design products that match the sound levels of original equipment and still offer increased performance, styling, or reduced cost. However, most manufacturers currently in the market only produce simple designs that are very similar from one manufacturer to another. These firms will have a hard time acquiring the technology and equipment to compete. Indeed, once these regulations are in effect, firms that could stay in the market may voluntarily choose to stop production of aftermarket exhausts in order to concentrate on a more profitable line of products. For a while some firms will continue to manufacture systems that can be used only on older bikes. Bikers will undoubtedly purchase systems designed for unregulated bikes to put on their "new," .q u ieted models. But as ~odeIs tum over this will become L more difficult. Eventually, EPA expects a net shrinkage in . aftermarket sales, with many firms going out of the business and a few holding even or Z gaining volume. r ZlJ z. H ow will state and local governments be involved in these , regulations? lo Fed era l regulations will pre-empt ,Z all state and local noise standards that apply to the sale of new motorcycles and new replacement exhaust systems. Local authorities, on the other hand, have the power to establish and enforce in-use standards for motorcycle noise. Local in -use programs that contain tampering and muffler laws are considered important in maximizing the benefits of EPA's new-product standards. The Agency is working to promote the adoption and enforcement of effective noise control programs in states and communities that do not yet have one. H ow can bikers express their views on this proposed rule? Anyone interested can write directly to EPA. As soon as the regulations are published, a 90·day public comment period will begin ; during that time any person, group, or organization may submit comments and opinions on the proposal.
