Department of Treasury's decision to extend its stu dy of Japanese motor cycle pricing ind ica tes both Treasury's desire to reach a just decision in th e motorcycle dumping case brought by Harley-Da vidson and the complex nature of that case. " W hile we a t Harley-Davidson and at our parent company, AMF Incorporated , wou ld like to see Trea sury make the appropriate finding in this case with a minimum of del ay , we recognize ,tha t it is not a simple case and we are reassured to learn that Treasury is ca refully studying the various issues we presented ," Davidson said. "We a re particularly gratified that Treasury is consid ering the use of Japanese mot orcycle prices in third countries, for models sold in the U.S . ' bu t not in the Japanese home m arket. This is a pr ocedure which HarleyDavidson has sugges ted from the outset and wh ich the J apanese firms h ave strong ly resisted." "T he addition al three months of .study ind ica tes to us that Treasury is lookin g carefu lly at th e da ta supplied nby the Cu stoms Service from th e sixmonth in vestigation on pricing that vbeg an last July. W e plan to cooperate full y by supplyin g any fu rt her information Treasu ry requests to help it reach a preliminary fin d in g ," he said . " Our only co nce rn is that delay in ' rea ch ing a prelim in a ry finding means del ay in requiring im porters to post bond in anticipation of a fin al deci sion to im pose dumpi ng duties. T reasury's conclusion, th a t thi s is a com plex case meri ting furt her stu dy , reflect s the (d ifficulty which J apanese firms have had in rebutting the evid en ce 1pres ented by H arley-Davidson. We will co nti nue to urge Treasury to tak e ~ a ct ion a t th e ea rl iest momen t cons istent with full co nsidera tion of '.the case ," David son added . Harley-Da vid son filed its pet iti on on June 7. 1977 , a llegi ng that J apanese mot or cycle m anu fa cturers were ( d um p ing cycles in th e United States. On Ju ly 14 , 1977 , T reasury a nnounced that it was begi nn ing a six -mont h inves tiga tio n of J apanese mot or cycle pric ing in m id -January 1978 . This preliminary finding now is to be ma de not lat er tha n three m on ths fro m now. After the prelim in a ry finding is nnoun ced. there will be a t hree mont h period du ring which b oth sides will submit arguments as to the co rrec tn ess of that finding . Then , a final det erm in at ion-on pricing will be _ made . If the determin ation is what the Japanese have been pricing motorcycles here at less than fair valu e, as HarleyDavidson a lleges , th e Intern a tion al Trade Co mmission is ca lled u pon to de te rm ine if such p ricing has inj ured the U .S. indust ry. If so, special du m p ing dut ies a re im posed to bri ng prices u p to fa ir value . T he J apanese sha re of th e V .S.· motor cycle market, co nt inues at very high levels.
