Ed. - Saving A Buck A Head Since April 1973 there has been a chain of events that we felt you should be aware of in the BLM vs. Cactus Cats litigation over non·payment of the $I per rider BLM fee. 1. After several threatening letters from J.R. Penny, we were fmally served a summons to answer their legal demands to Bryan Freema!1, Assistant U.S. Attorney in Los Angeles. 2. We applied for a race permit early in June for our race date on the calendar of December 8, 1973 and after a lengthy delay we were finany denied the permit on the basis that we had not paid the rider fee for the January race (all other conditions of the permit requirements had been met). We then had to cancel our race date on the calendar with District 37. 3. In other areas such as public campgrounds, boat loading ramps, and other such recreation arien ted areas, where in the past a fee has been charged, now charging of the fee has been discontinued by congressional order, on the basis that "the charging of the fee was not in proportion to the service that was provided by the Federal or State ". (What service is the BLM providing for your II?) 4. We have been advised from various contacts that "The BLM does not want this to go to court," as they feel they are on very weak ground in this matter. I t seems as though the federal attorneys might drag this case out for some time to come, as the hearings have been delayed several times. As a club the Cactus Cats feel as though this might be resolved if other clubs were to support our cause with a similar action. After all they can overlook one situation but if the problem were to multiply, it would have to be resolved. In addition, if this is resolved in our favor, the obvious next move would be to file a class action suit to recover funds paid in the past 13 months. This would amount to a tidy sum, which we are sure could be put to some worthy cause, such as equipment for the various rescue organizations, which in turn, benefit us all. We might add for clarification that, we have no quarrel with the personnel working out of the local or regional BLM offices, the people that we have dealt with on matters of the permit and other contacts regarding this matter have been ex tremely cooperative and pleasant in every way. The track is designed to drain and dry out quickly after the Northwest's seasonal rains. Races will be run twice a month, the next on November 25.
