The Forest Service regulations, as they were when first proposed (rmal regulations are not available before release due to the restrictions of the Administrative Procedures Act) follow. The regulations in this part pertain to administrative designation of specific areas and trails of National Forest System lands on which the use of off~road veh iclas shall be allowed, restricted. or prohibited and establishing controls governing the use of off-road vehicles on such areas. (b) "National Forest System lands" means National Forests, National Grasslands, and other lands and Interests in lands administered by the Forest Service. (C) "Official use" means an employee, agent, or designated representative of the Forest Service or one of ifs contractors In the course of his employment. agency. or representation. On National Forest System lands the continuing resource planning process will provide for designation of specific areas and trails for off-road vehicle use. use restrictions, and closures to any or all types of such use. The planning procHs will analyze and evaluate alternatives to enable decisions which best balance protection of the re~urces, promotion of safety for all users, minimization of use confUcts, and accomplishment of all of the other resource objectives for National Forest System lands. Analysis and evaluation of off-road vehicle uses wjll take into consideration factors such as noise, safety, quality of the various recreational experiences provided, potential Impacts on soil. watersheds. vegetation, fiSh. Wildlife, fish and wildlife habitat.l and existing or proposed recreational uses OT the same 01 neighboring lands, The pub Ilc shall be provided an opportunity to participate in the designation of areas and trails relating to off.road vehlele use. Advance notice will be given to allow review by the public of proposed designations or revisions of designations of any areas or trails for off-road vehicle use, for restrictions, or for closures to such use. Time will be allowed for public response prior to any designations or revisions. Areas and trails where off-road vehicle use Is restricted or prohibited shall be marked with appropriate signs. Notices of restrictions o'r notices of the closure shall be posted so as to reasonably bring them to the attention of the pUblic, and a copy of the restriction order or closure order shall be kept available to the public in the Offices of the District Rangers and Forest SuperYrsors. fnformatlon and maps will be published' and distributed describing the conditions of use and the time periods when areas and trails are: (a) open to off· road vehicle use, \b) restricted to certain types of off·road veh cle use, (c) closed to off·road veh Icle uses. Use of off-road vehicles on National Forest System lands where the use of off-road vehicles 15 prohibited may be allowed for official use or with prior authorization by means of an Off· Road Vehicle permit. Off· Road Vehicle permits may be issued by the Chief, Forest Service, and such permits will be for a specific area, conditions-of useJ and a definite period of time. Off·Roaa Vehicle permits shall be revocable for violation of the rules and regutatlons governing the ~ti~I)~1 Forests. Note that the regulations exclude certain vehicles used in mmmg operations under the General Mining Act of 1872. It is, of course, very coun terproductive to try to "preserve" an area by controlling recreational ORV use and yet exempt mining, one of the most earth-scarring ecological in terferences man has ever developed. However, that's the way the law reads, and the prospects of changing it soon are bleak. The Forest Service will also soon release a draft environmental statement, which is interesting because it actually recognizes the economic factor involved in the ORV question as well as the mining vehicle exemption issue, and is fairly objective. Offhand, it would appear that Lamb wrote it, as it reads the way he talks. According to Lamb, there will be an opportunity for public comment on this impact statement when it is released in its draft form at the same tilDe as the final Forest Service general ORV regulations are released. So you see, the BLM is not the only government agency that will be making an impact on the dirt rider in the coming decade... the Forest Service is already well into its act.
