m.o.r.e. from tlle ca~ilol' , by Russ Sanford On September 23m, the California Departmen t of Parks and Recreation and the Off Highway Vehicle Section of the DMV conducted a join t meeting with the California Off Road Vellicle l"I.ssociation (CORVA) in Altadena. The purpose of the meeting was to discuss and explain the Off Highway Registration program and for ORV enthusiasts to obtaio first·hand answers to their questions. A Ithough the meeting was well-publicized in advance, only two motorcyclists were in attendance: Mr. Richard Brown representing the California Recreational Trails Committee, and myself. I had expected a big turn-out of representatives Irom AMA District 37, the MIC, the CMIC, not to mention Alice Rhea, Harry Whalen, and a few other individuals who have expressed concern with the program. I felt that . those in attendance received, a lot of insight into the program and left the four-hour meeting quite' well satisfied with the program. Several interesting observations were made during the 'meeting that bear repeating. up to $100, and for any subsequent convictions within one year a fine of up to $250. Your help in fostering maximum public compliance with Div. 16.5 will be greatly appreciated. Such action would be most welcome, and is urgently needed. There are direct local benefits. Of every $15 two-year fee for OHV identification, $4 is distributed to cities and counties in lieu of all property taxes on such vehicles (on the basis of population ratios), This money is intended for off-highway vehicle recreation facilities and for related law enforcement. I n addition, the Department of Parks and Recreation administers a local grants program out of its share of each OHV identification fee. Thus, the greater the degree of 'public compliance, the more revenue available for state and local OHV programs. Cozens Director" POSSIBLE LAW CHANGE One of the attendees asked why the CI-IP wasn't enforcing the ORV Registration program, and received the answer that becau~e the law pertained to off-highway vehicles, the CHP had 110 jurisdiction. Mr. Robert Meyers of State Parks and Recreation followed that comment with a statement that as it now stands, the CHP cannot intervene because persons who transport an off-road vehicle upon the highways can always claim that they are headed for an exempted category ie, sanctioned competition, a commercial facility, or private land upon which they have permission to ride. Mr. Meyer further stated that if the Southern California ORV enthusiasts continued to defy the law, legislation would be sough t to remove the exemptions and then the CHI' would have jurisdiction and could issue citations for any faiJure to satisfactorily register and identify off-road vehicles. PROGRAM ENFORCEMENT Those presen t at the meeting received 'information copies' ,?f the following bulletin issued by the Dept. of Motor Vehicles:, . "TO ALL CALIFORNIA SHERIFFS AND POLICE CHIEFS: This is to inform you that the non-penalty period for public compliance with Div. 16.5 of the Vehicle Code, requiring special identification of off-highway vehicles using public land (unless otherwise licensed or exempt). has expired. Accordingly. active enforcement may now begin in all areas where it is not already under way. In addition to vehicles using PUBLIC lands without the required identification, vehicles I USING, PRIVATE LAND WITHOUT EXPRESS PE RMISSION of the owner or tenant can be cited for failure to obtain and display the special sticker. This would be IN ADDITION TO ANY TRESPASS CITATION ISSUED. REPERCUSSIONS 1 hope that those who are failing to comply with the law recognize what they are about to set in motion by their actions. Such a change would mean that registration and identification would be required throughout the entire state Violations of Div. 16.5 provisions are classified as infractions (see.p. 752 VCL-As such, Section 42001 (a) provides that a first conviction carries a fine of up to $50, a second conviction within one year a fine of v.. .. .. ,..... .. .. .. .... , , , '.. .. .. .. .. .. .. ' with no exceptions. For example, your children wouldn't even be allowed to ride their mini-bike in your own back-yard without paying the fee. NOR:rHERN CALIFORNIA MEETING The Southern California meeting was so successful that we have prevailed upon the State to conduct a similar meeting in Northern California. It will be held in Sacramento on Satl,lrday, November lIth,. at 9:00 AM, in the Ground Floor Auditorium of the Resources Building, 9th and "0" Streets. All off-road vehicle enthusiasts are invited to attend. CALIFORNIA RECREATIONAL TRAILS COMMITTEE The California Department of Parks and Recreation has just announced a series of hearings to be held throughout the state for the purp.ose of detertl)ining regional" needs prior to developing regional off-road vehicle facilities. Herewith, their bulletin: "NOTICE OF PUBLIC MEETINGS . SUBJECT: OFF HIGHWAY VEHICLE USE "AND CONTROL In orde'r to provide the public with an opportunitY to participate in the development of its study of off-highway vehicle use and control, the California Department of Parks and Recreation has scheduled a series of one-day meetings to receive statements from interested parties. These meetings, to be held before the California Recreational Trails Committee, are scheduled as follows: ~ ~~ Because of the number of parties expected to testify, presentation time will be restricted to five minutes, All oral testimony should be supplemented by ten copies of written material which will be made available to the Committee members. In addition, organizations should present consolidated testimony on behalf of chapters or units. While 'content of the testimony is not restricted, factual information on the following topics will be of greatest value to the committee: 1. Design standards for off-highway recreational vehicle trails and areas. 2. Safety considerations for vehicles, users and areas. 3. Noise Tolerances. 4. Erosion considerations. 5. "Rules of the road" for off-highway vehicle operation. 6. Criteria for the local grant program. 7. Criteria for locating both state and local projects. 8.
