WHEREAS, the Motorcycle Industry Council, representing over 90% of the motorcycle industry recognizes that sounds emitted from some off·road motorcycles disturb the peace and quiet of other citizens, and WHEREAS, most vehicle regulations do not. deal effectively with the sound level requirements for motorcycles not manufactured for use on public roads, and WHEREAS, the Motorcycle Industry Council wishes to self·regulate noise levels for off·road motorcycles to the extent of its abilities while still promoting the healthy r,ecreation of off·road riding in harmony with noncyclists, NOW THEREFORE BE IT RESOLVED, that it is the position of the Council that all motorcycles (except professional racing motorcycles other than for Moto-Cross) produced after December 31, 1971 for sale to the public be equipped with a muffling device which does not produce over 92 Db(a) at 50 feet under the recommended Council t~ing procedures attachect The Motorcycle Industry Council will further actively urge accessory suppliers and dealers not to sell exhaust equipment which does not comply, and together with the motorcycle enthusiast press, promote the use of silencers or quieter systems on noncomplying motorcycles now in use. Knievel, were released today by Bill Boyce of the AMA. Since the motocross, set for May 22-23, is a non-National event, Boyce reports that it will-be run as such. No entry fees are required, but all participants must have an AMA license. The Juniors signing up on Saturday are required to have a competition license. These licenses can be obtained by mailing $7 to the AMA. The Expert riders, competing Sunday for a guaranteed $10,000 purse, must have an AMA Professional license. Also, these Experts will be required to pay the usual $4 insurance fee before racing. The event will have only two classes, 250cc and Open. As of this time, the AMA has not decided whether to run three 20-minute motos in each class or two 30-minute motos. Boyce also stresses the fact that this event has no closed entry. That is, if you fulfill the requirements (licenses, etc.) you will ride. On February 28, 1971, a motorcycle rider whom we shall call "John Doe" was arrested for riding his motorcycle on private property without written permission. The citation alleged a violation of Fullerton, Cal. Municipal Code Section 7.100.010. The defendant appeared on the citation as required, through the law firm of Lawton, Christensen, Fazio Be McDonnell and entered a demurrer on the grounds that the ordinance was unconstituti9nal. On April 21 a hearing on the demurrer was held be"fore the Honorable James O. Perez in the North Orange County Municipal Court and, based on pleadings and briefs filed by both the City and counsel for the defendant, Judge Perez sustained the demurrer and, in effect, found that the Fullerton Municipal Code section in question was unconstitutional due to the fact that the state of California has pre·empted the field of trespass through its section 602 of the Penal Code, which regulates the kind of conduct considered trespassory. The citation was dismissed. Now the city of Fullerton has the option of: 1. Appealing the decision·to the Superior Court. 2. Passing a new ordinance in hopes of coming up with something constitutionally valid. 3. Letting it ride and hoping that other people do not contest their tickets, as if often the case; that is, most people cited under the section have gone in and paid the ticket without contesting it. Under the present state of the law, at least in North Orange County, it would seem that any defendant could demur to the citation and ask that it be dismissed even without an attorney, and the judge would probably grant the motion and dismiss the ticket until some further action is taken by the city of Fullerton. 1e6k!a keah IIi' f#UI ",e~fi Joel Robert" who looks suspiciously like the best motocrosser in history, now holds the world's record at 38 Grand Prix wins after his recent victory in the 250cc Swiss "C.P. The 27-year-old Belgian had now won all four championship races this year and has one-bettered the previous GP record of 37, held by Sweden's Torsten Hallman. "I am delighted to have passed Torsten's record of victories," said Robert. "Now my greatest ambition is to win the world championship for the fifth time, and better the record of four world titles which Torsten and 1 hold." Robert also expressed his a tti tude about the younger riders: "My tactics this season are to get away first in .every race and build up big leads. But if riders like Torlief Hansen and Heikki Mikkola wan t to play games, 1 will let them. 1 will catch them." ' EVEL TO MAD. GARDEN IN JULY Concurrently with the opening of his new motion picture in July, famed stunt daredevil Evel Knievel will appear in a 5-day show at New York's Madison Square Garden.
