Word bas leaked out that the federal governm ent bas Indicated that It Intends to withdra w 10% of Callforn !a's federal highway aid funds If tile slate doesn't enforce the helmet law for motorcy cUsts. With this sort of 1epl blackm all, Callforn Ja's motorc ycUsts are going to bave to swallow a bitter pill, unless we can effectiv ely band togethe r and make a show of strenctb. There have been so many letters writ- ten and pOlnts- of-view express ed on the pros and cons of helmets that It Is Uttle wonder that our legislat ors bave fll11ed kl see tile true Issue: that of constitu tional rirbl. Granted , the wearing of helmets makes rood sense and most motorcy cUsts won't r1c1e without one. But as long as not weartnr a helmet does not endanger anyone else'S safety or well-be ing, tile molorcy cUst Intends to stand on his constitution al right and make his own decision about belmets and any other protective device. As MORE's lobbyis t, I am going to ensure that our legislat ors recogni ze that we motorcy cUsts are wel1aw are of the benefits of protect ive devices and that we appreci ate their concern for our welfare. But that the same type of thinking holds irue for the occ\lPlLllts of any vehI<:.1e. It would be interes ting to see their reaction to wives who appeare d at cocktall parties and secreta ries arriving for work (or vice versa) alter donn1rlg helmets over bouffan t balrdos . ThIs past legislat ive session saw the Introdu ction of propOsed helmet legislation by Assemb lyman John Francis Foran of San Francis co'S 23rd DIstric t who was subsequ ently joined by Assemblyman Tom Hom of San DIego's 79th Dtstrlct . Their Assemb ly Bill 654 proposed the addition of two sections to lbe Vehicle Code. The first, Section 27802, deals with the estabUs hlng of safety standar ds for helmets and prohibi ts the use or sale of sub-sta ndard helmets . The second, Section 27803, require s twowheeled motorcy cle operato rs and passengers to "wear uPOn his head a securely fastened safety helmet at all times the motorcy cle is being two-wb eeled driven" • Due to heavy opposit ion, AB 654 did not pass and bas been revised twice. The latest revision , Introduc ed on AprU 21, 1969, drops Section 27803 entirely , and revises Section 27802 to read (In part): "The departm ent sball adopt reason. able regulati ons eslabUs hlng specif1cations and standar ds for sate!;Y belmets to be worn by motorcy cle drivers and passeng ers lUI It determi nes are necessary for tile safety of sucb drivers and passeng ers. In develop ing 1Iw regu1at ions, the departm ent sball conside r all standar ds whicb bave been developed and adopted as a require ment by other states" . ThIs revision , altllougb not yet approved, appears Innocen t enough.
